The Sales Agent – Distributor of DQ&Co Terms & Conditions of Sale

For end consumers all prices are in New Zealand dollars and are GST inclusive. For wholesale customers all prices are in New Zealand dollars and are GST exclusive. For online orders you may pay by supplying your credit/debit card details on our secure online ordering system. You may also choose to pay via Internet Banking. The Sales Agent operates the highest level of security, meaning your card details are not retained. Should you wish to add to your order, or if we need to issue a refund we may need to contact you to obtain your card details. All payments for goods must be made when the order is placed. We are unable to reserve or dispatch goods before payment is received. In some instances there may be small variations to the price shown on your credit card statement from the price you have paid for your order. This occurs because of the time delays, and subsequent exchange rate fluctuation, between the day we charge your card and the day your credit card company charges your account. A surcharge may also be added by some credit card companies for international currency transactions. Any customs charges or sales taxes upon entry to your country are excluded from our prices. Please be aware that some countries employ random checks on parcels and if you are unlucky you may need to pay a small percentage of the value of you’re the Sales Agent DQ&Co purchase as a tax to your government. Any such charges incurred will be your responsibility to pay. We promise to use the products as advertised online. If for any reason a product is out of stock, we promise to replace that product with another as close to it as we possibly can, and one of similar or greater value. If you have specified a delivery date, we will try our best to deliver the products by this date but late delivery does not entitle you to cancel any order and are not our responsibility. The Sales Agent cannot take responsibility for late delivery of any gifts due to: - Adverse weather conditions - Incomplete or incorrect delivery addresses - Traffic congestion - Any other causes beyond our reasonable control and not limited compliance with laws or regulations, Acts of God, pandemics, acts or omissions of the purchaser, acts of civil or military authority, judicial action defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots. We will re-deliver, replace or refund the product (at our option) if we have incorrectly addressed the delivery but we take no such responsibility if you gave an incorrect or insufficient address, or if there was no delivery due to the premises having no safe access point. Please note our couriers do not collect on weekends. Orders placed after 3pm Friday will be dispatched on the following Monday (except for public holidays).

ITEMS DAMAGED IN TRANSIT, DEFECTIVE OR INCORRECT ITEMS

In the unlikely event your gift is damaged please contact us within 5 days on 0211626065 or info@dqcompany.com. We will make arrangements for the return of the gift and refund or replacement (at your choice). Please note that we may request photos of the damage and packaging in order to enable us to investigate the matter with our courier and packing facility.

GOVERNING LAW

These Terms & Conditions of Sale (and any contracts to which these Conditions of Sale apply) shall be governed by the laws of New Zealand and the courts of New Zealand shall have non-exclusive jurisdiction to hear and determine any dispute arising in relation to these Conditions of Sale (and any contracts to which these Conditions of Sale apply)..
